                Welcome to MobiSpend! These terms govern your use of our app. By using MobiSpend, you agree to these terms. Please read them carefully.
            

1. Acceptance of Terms

By downloading, installing, or using the MobiSpend mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

MobiSpend is operated by Hightlight Software Limited ("we," "us," or "our"), a company registered in Rwanda.

2. Description of Service

MobiSpend is a personal finance management application that:

Reads SMS messages from mobile money providers to automatically track your transactions
Stores transaction data on your device by default, with optional cloud features requiring your consent
Provides spending insights and categorization tools
Helps you manage multiple mobile money accounts in one place

3. User Eligibility

You must be at least 13 years old to use MobiSpend. If you are under 18, you must have permission from a parent or legal guardian to use the App.

By using MobiSpend, you represent and warrant that you meet these eligibility requirements.

4. User Accounts

4.1 Account Creation

You may need to create an account to use certain features of MobiSpend. When creating an account, you agree to:

Provide accurate and complete information
Maintain the security of your password and account
Promptly update any information to keep it accurate and current
Accept responsibility for all activities under your account

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately at mobispendapp@gmail.com if you believe your account has been compromised.

5. Permissions and Data Access

5.1 SMS Permission

MobiSpend requires permission to read your SMS messages to function properly. By granting this permission, you authorize the App to:

Read SMS messages from mobile money providers
Parse transaction information from these messages
Store parsed data locally on your device

                Your Privacy Matters: We only read messages from recognized mobile money providers. By default, all data stays on your device. If you opt into cloud sync features, your transaction data (including message content) will be encrypted and synced to our servers.
            

5.2 Data Storage

All transaction data is stored by default on your device. We are not responsible for data loss due to:

Device damage, loss, or theft
App uninstallation or data clearing
Device factory reset
Operating system issues

6. Acceptable Use

You agree to use MobiSpend only for lawful purposes. You must not:

Use the App in any way that violates local, national, or international law
Attempt to reverse engineer, decompile, or disassemble the App
Use the App to track transactions that are not your own without proper authorization
Circumvent or disable any security features of the App
Interfere with or disrupt the App's functionality
Attempt to resell or redistribute the App

7. Intellectual Property

The App and its original content, features, and functionality are owned by Hightlight Software Limited and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal and commercial purposes.

8. Third-Party Services

MobiSpend integrates with mobile money providers but is not affiliated with, endorsed by, or officially connected with any mobile money service. We are not responsible for:

The accuracy of transaction information provided by mobile money SMS messages
Changes to SMS message formats by mobile money providers
Any issues with your mobile money accounts or transactions

9. Disclaimers and Limitations of Liability

IMPORTANT: MobiSpend is provided "as is" without warranties of any kind. Please read this section carefully.

9.1 No Financial Advice

MobiSpend is a transaction tracking tool only. We do not provide financial, investment, legal, or tax advice. Any insights or recommendations provided by the App are for informational purposes only.

9.2 Accuracy of Data

While we strive for accuracy, we cannot guarantee that:

All transactions will be captured correctly
Transaction categorization will always be accurate
Balance information will match your actual mobile money balance

You should verify important transaction information with your mobile money provider.

9.3 Limitation of Liability

To the maximum extent permitted by law, Hightlight Software Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

Your use or inability to use the App
Any unauthorized access to or use of our servers
Any bugs, viruses, or other harmful code
Any errors or omissions in transaction data
Any conduct or content of any third party

10. Subscription and Payments

MobiSpend may offer premium features through subscription plans. If you choose to subscribe:

You will be charged the subscription fee through our payment provider
Subscriptions automatically renew unless cancelled
You can cancel at any time through the app or by contacting support
Payment processing is handled by secure third-party payment providers
Refunds are handled according to our refund policy, which will be provided at the time of purchase

We reserve the right to change subscription pricing with 30 days advance notice to existing subscribers.

11. Termination

11.1 Termination by You

You may stop using the App at any time by:

Uninstalling the App from your device
Requesting account deletion at mobispendapp@gmail.com

11.2 Termination by Us

We reserve the right to suspend or terminate your access to the App at any time, without notice, for:

Violation of these Terms
Fraudulent or illegal activity
Extended inactivity

12. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:

Posting the updated Terms in the App
Updating the "Last Updated" date
Sending you an email notification (if applicable)

Your continued use of the App after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Rwanda, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved in the courts of Kigali, Rwanda.

14. Dispute Resolution

In the event of any dispute, claim, or controversy arising from or relating to these Terms:

You agree to first contact us at mobispendapp@gmail.com to attempt to resolve the issue informally
If informal resolution fails, both parties agree to mediation before pursuing litigation
Any legal action must be brought within one year of the cause of action arising

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Hightlight Software Limited regarding the use of MobiSpend.
